Knobbe Martens Secures Victory for Client Nobel Biocare USA

Knobbe Martens Olson & Bear LLP, one of the largest intellectual property law firms in the United States, received an order from the U.S. District Court for the Eastern District of Virginia in Nobel Biocare USA, LLC et al v. Technique D’Usinage Sinlab, granting client Nobel Biocare’s motion for summary judgment of non-infringement of all patents-in-suit in an action against Sinlab. In addition, the Court granted all of Nobel’s evidentiary motions, including a motion to exclude the patentee’s damages, and declared Nobel as the prevailing party in the litigation.

In the summer of 2012, Sinlab accused Nobel of willfully infringing several U.S. patents relating to surgical planning software, dental implant drill guides and overdenture bars. A team of Knobbe Martens attorneys utilized the new venue provisions of the AIA and filed a declaratory judgment action of non-infringement and invalidity on Nobel’s behalf, enabling them to resolve the case in only six months after initiation. During the litigation, the attorneys were successful in limiting the patentee’s theories of infringement and excluding expert testimony.
