District Court Grants Knobbe Martens Motion to Stay Litigation Pending IPR on Behalf of Client Smith & Nephew

Knobbe Martens Olson & Bear LLP has successfully obtained a stay pending inter partes review (IPR) on behalf of client Smith & Nephew, Inc. from the district court for the Western District of Tennessee. The motion effectively halts litigation in the patent infringement case brought by non-practicing entity, AngelFix LLC, relating to variable angle bone plates and screws for use in orthopedic surgery.

In a strategic move, Knobbe Martens petitioned the United States Patent and Trademark Office for IPR, and on April 8, the Patent Office instituted review of all claims asserted in the litigation. Christy Lea, lead trial and IPR counsel for Smith & Nephew, immediately moved to stay the district court litigation until the Patent Office renders a final decision in the IPR.
