Knobbe Martens Secures Another Victory for Spectrum Solutions in Long-Running Battle Against DNA Genotek
PTAB sides entirely with Spectrum in IPR proceeding against DNA Genotek
IRVINE, Calif., February 20, 2024 – A team from Knobbe Martens led by Ali Razai secured another victory for Spectrum Solutions LLC in its long-running battle against DNA Genotek Inc. The team successfully invalidated all asserted claims of U.S. Patent No. 11,002,646 owned by DNA Genotek in an inter partes review (IPR) proceeding before the USPTO’s Patent Trial and Appeal Board (PTAB). In a Final Written Decision issued on February 7, 2024, the PTAB sided entirely with Spectrum in cancelling all challenged claims in the ’646 patent.
This IPR victory comes on the heels of Knobbe Martens’ decisive win for Spectrum in the related district court case, where the firm secured summary judgment of non-infringement on the same ’646 patent. DNA Genotek originally filed suit against Spectrum in March 2021, alleging that Spectrum’s innovative and highly successful COVID-19 testing devices infringe two DNA Genotek patents, including the ’646 patent. In May 2023, the court granted Spectrum’s motion for summary judgment that the Spectrum devices do not infringe either of the asserted patents.
